Your rights of appeal

Appeal to Elgin Middlesex Soccer Association (EMSA)

You have the right to appeal the decision of the of your Club or League.

This decision may be appealed to Elgin Middlesex Soccer Association (EMSA) and may be appealed by any party affected by the decision.

The letter of appeal must specify your rationale for appealing the decision of the Club/League and be accompanied by the $250 appeal fee.  The appeal fee will be retained if your appeal is unsuccessful.  It will be returned if your appeal is successful. 

Your rational must include, a copy of the original decision AND:

    1. New facts not available when the Club/League decision was made or not available at previous hearings; or

    2. Specific procedural errors made by the Club/League or at previous hearings; or

    3. Specific instances where Articles and Rules have been wrongly interpreted by the Club/League or at previous hearings.

    4. Alleged excessive fine, fee, bond or suspension.

Failure to provide an adequate rationale will result in your appeal being ruled out of order and disallowed.

Payment of the appeal fee of $250 to EMSA must be received before your appeal will be reviewed. 

The appeal must be submitted to EMSA at discipline@emsadistrict.com no more than five (5) days (weekends and holidays excluded) from the receipt of the written decision rendered by the Club/League.

 

Appeal to Ontario Soccer

You have the right to appeal the decision of the Elgin Middlesex Soccer Association (EMSA).

You need to submit the Ontario Soccer Appeal Application Form with the applicable fee ($750).  


4.1 Canada Soccer Registrants and/or Registered Organizations who wish to seek Leave to Appeal a decision will have fourteen (14) days from the date on which they received notice of the decision together with their rights of appeal, to submit in writing the following: (Note: this is for appeals to Ontario Soccer only)

4.2  Decisions may only be appealed, and appeals may only be heard, upon the following grounds:

a) The decision made is beyond the authority and jurisdiction of the decision maker as set out in applicable governing documents.

b) New facts now available that were not in existence or could not have been discovered by due diligence when the decision was made.

c) The decision maker failed to properly interpret the relevant Published Rules.

d) The decision maker failed to follow procedures as described in the relevant Published Rules.

e) The decision was influenced by bias, where bias is defined as a lack of neutrality to such an extent that the decision-maker is unable to consider other views. The decision is excessive of the guidelines established related to fines, fee, penalties or bonds

If the requirements of Procedure 4.1 are not met within the 14-day period, the request will be ruled out of order and will not be heard. 

The appeal shall be submitted in writing to appealcasemanager@ontariosoccer.net or by registered mail, recognized Courier Service or by hand delivery to:

The appeal must be submitted no more than five (5) working days from the receipt of the written decision rendered by the EMSA.
